Welcome to The Beauty Distro. These Terms of Service ("Terms") govern your access to and use of thebeautydistro.com (the "Site") and your purchase of any products from us. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

The Site is operated by The Beauty Distro ("we," "us," or "our"), based in Irving, Texas (Dallas County), USA.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By purchasing, you represent that you meet this requirement and that the information you provide is accurate and complete. Minors may use the Site only with the involvement of a parent or legal guardian.

2. Accounts

If you create an account, you are responsible for keeping your login credentials confidential and for all activity under your account. Notify us at support@thebeautydistro.com of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Products, Descriptions & Authenticity

The Beauty Distro is an independent reseller and distributor of authentic third-party beauty and cosmetic brands. We are not the manufacturer of the products we sell. The formulation, ingredients, manufacturing, safety, and labeling of each product are the responsibility of the respective brand or manufacturer.

We work to display products, shades, and descriptions accurately, but we do not warrant that descriptions, colors, images, or other content are error-free, complete, or current. Because many items are imported and curated, normal variation between units — in packaging, labeling, batch codes, fill lines, scent, or minor manufacturer reformulations — may occur and is not a defect. Colors may appear differently on different screens.

4. Pricing & Errors

All prices are in the currency shown at checkout and are subject to change without notice. Despite our best efforts, products may occasionally be mispriced or contain errors. We reserve the right to correct any errors and to refuse or cancel any order placed for a product listed at an incorrect price or with incorrect information, even after an order is submitted. If we cancel for this reason, we will issue store credit or a refund for the affected item.

5. Orders, Acceptance & Right to Refuse

Your order is an offer to buy. We reserve the right to accept, decline, limit, or cancel any order at our sole discretion, including for suspected fraud, payment risk, inventory limits, unserviceable addresses, or violations of these Terms. All orders are subject to product availability.

6. Payment

You represent that you are authorized to use the payment method provided. By submitting payment information, you authorize us (and our payment processors, including any buy-now-pay-later provider such as Klarna) to charge the total order amount. We are not responsible for fees charged by your bank or payment provider.

7. Cancellations

Once an order is placed, it cannot be cancelled or modified by the customer. Please review your cart, shades, quantities, and shipping address before checkout. Our full terms are set out in our Cancellation Policy.

8. Shipping & Risk of Loss

Risk of loss and title pass to you upon our delivery of the package to the shipping carrier. We are not responsible for packages lost, stolen, delayed, or damaged in transit; carrier issues must be pursued with the carrier. See our Refund & Return Policy and Shipping Policy for details.

9. Returns & Refunds

All sales are final. We do not accept returns or offer refunds, exchanges, or store credit except for an item that is wrong or defective due to our error, as described in our Refund & Return Policy, which is incorporated into these Terms by reference.

10. Sold "As Is" — Disclaimer of Warranties

To the fullest extent permitted by law, all products and the Site are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

11. Assumption of Risk — Cosmetics & Skin Sensitivity

Cosmetic and personal-care products may cause reactions in some individuals. You are responsible for reviewing ingredient lists, following usage directions, and patch testing before use. Allergic reactions and skin sensitivities are not the responsibility of The Beauty Distro and are not grounds for a refund, replacement, or store credit. Discontinue use and consult a healthcare professional if a reaction occurs.

12. Limitation of Liability

To the fullest extent permitted by law, The Beauty Distro's total liability to you for any claim arising out of or relating to a product, your order, or the Site is limited to the amount you paid for the product(s) at issue. We are not liable for any indirect, incidental, special, punitive, or consequential damages, or for any injury, loss, or damage arising from the use, misuse, or application of a product, to the fullest extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless The Beauty Distro and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of a product, or your violation of any law or third-party right.

14. Chargebacks & Payment Disputes

You agree to contact us first at support@thebeautydistro.com to resolve any issue before initiating a chargeback or payment dispute. Filing a dispute without first contacting us is a breach of these Terms and may result in suspension and being blocked from future purchases. We maintain records of all orders, shipments, and communications to respond to disputes.

15. Intellectual Property

All content on the Site — including logos, text, graphics, images, and design — is owned by or licensed to The Beauty Distro and is protected by intellectual property laws. You may not copy, reproduce, or use our content without our written permission. Product names and brand marks belong to their respective owners.

16. User Content & Reviews

If you submit reviews, photos, comments, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and share that content for marketing and operational purposes. You are responsible for your submissions and must not post unlawful, infringing, or misleading content.

17. Prohibited Uses

You agree not to use the Site or products to: violate any law; commit fraud; resell our products in a way that misrepresents them; interfere with the Site's security or operation; or infringe the rights of others. We may terminate access for any prohibited use.

18. Third-Party Links & Services

The Site may link to or integrate third-party services (such as payment, shipping, or pickup providers). We are not responsible for the content, policies, or practices of third parties.

19. Changes to These Terms and the Site

20. Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to their jurisdiction.

21. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Refund & Return Policy, Cancellation Policy, Shipping Policy, and Privacy Policy, constitute the entire agreement between you and The Beauty Distro. Nothing in these Terms limits any non-waivable rights you may have under applicable consumer-protection law.
